The terms and conditions governing your use of NexusRise services
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and NexusRise, a service of The PIE Group Initiative ("NexusRise," "we," "us," or "our"), governing your access to and use of our internet, mobile, and related services, as well as our website at nexusrise.net.
You must be at least 18 years of age and legally capable of entering into a binding contract to use our services. By using our services, you represent and warrant that you meet these requirements. NexusRise services are currently available to residents and businesses within our Eastern Seaboard service corridor (New York to Florida).
NexusRise offers the following service tiers:
Service availability is subject to coverage area, equipment requirements, and network conditions. NexusRise reserves the right to modify, suspend, or discontinue any service with reasonable notice.
To receive services, you must provide accurate, current, and complete information during enrollment. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree to use NexusRise services only for lawful purposes and in a manner consistent with our Acceptable Use Policy. Prohibited uses include, but are not limited to:
Violation of the Acceptable Use Policy may result in immediate service suspension or termination without refund.
Certain service plans require installation of equipment (routers, CPE devices, or SIM cards) at your service location. Equipment provided by NexusRise remains our property unless otherwise stated. You are responsible for the safekeeping of such equipment and may be charged for loss or damage beyond normal wear and tear.
NexusRise strives to provide reliable service but does not guarantee uninterrupted, error-free, or continuously available service. Service may be temporarily interrupted due to scheduled maintenance, equipment failures, weather, or causes beyond our control. NexusRise is not liable for service interruptions caused by third-party network providers, acts of nature, or circumstances outside our reasonable control.

Complex network issues may be escalated to Tier 2 or higher support at our discretion. We aim to respond to all support requests within one business day.
By You: You may cancel your service at any time by contacting us. Cancellations take effect at the end of your current billing period. You remain responsible for all charges incurred through the cancellation date.
By NexusRise: We may suspend or terminate your service immediately for violation of these Terms, non-payment, or illegal use of our services. We may terminate service with 30 days' notice for any other reason.
Upon termination, any NexusRise-owned equipment must be returned within 14 days or you may be charged for its replacement cost.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEXUSRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
NEXUSRISE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
You agree to indemnify, defend, and hold harmless NexusRise, The PIE Group Initiative, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any rights of a third party.
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described therein.
NexusRise reserves the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a notice on our website. Your continued use of our services after the effective date of the revised Terms constitutes your acceptance of the changes.
These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved first through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in South Carolina under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and NexusRise regarding your use of our services and supersede all prior agreements and understandings.
