Acceptable Use Policy

1Purpose & Scope

This AUP applies to all subscribers, household members, guests, and authorized users accessing NexusRise internet or mobile services. It covers all devices connected through our network, including routers, smartphones, tablets, computers, smart home devices, and any other internet-enabled equipment.

NexusRise provides connectivity services to rural and underserved communities along the Eastern Seaboard. Our mission depends on every subscriber using the network responsibly and fairly.

2Permitted Uses

NexusRise services are intended for the following lawful personal and small business purposes:

3Prohibited Activities

The following activities are strictly prohibited on all NexusRise services. Violation may result in suspension or termination of service.

4Network Management & Fair Use

To ensure a high-quality experience for all subscribers, NexusRise may implement the following reasonable network management practices:

• Traffic Prioritization: During periods of network congestion, time-sensitive traffic (voice, video calls) may be prioritized over background downloads.
• Speed Throttling: Unlimited plan subscribers who exceed monthly high-speed data thresholds may experience reduced speeds (typically to 1–3 Mbps) for the remainder of the billing cycle.
• Hotspot Speed Caps: Mobile hotspot data may be subject to speed limits after the high-speed hotspot allotment on your plan is reached.
• Congestion Management: During peak hours, overall network speeds may vary based on available capacity and local tower conditions.

NexusRise does not throttle, block, or discriminate against specific lawful content, applications, or websites.

5Content Standards

While NexusRise does not monitor subscriber internet traffic, we require that our services not be used to host, distribute, or transmit:

• Child sexual abuse material (CSAM) or any sexual content involving minors
• Content that incites violence, terrorism, or hate crimes against any group
• Material that defames, libels, or falsely disparages any individual or organization
• Content designed to defraud, deceive, or mislead others
• Any content that violates applicable federal, state, or local laws

NexusRise will cooperate fully with law enforcement when presented with valid legal process regarding prohibited content.

6Security Responsibilities

Subscribers are responsible for maintaining the security of their own devices and home networks, including:

• Keeping routers, computers, and devices updated with current security patches
• Using strong, unique passwords for Wi-Fi networks and online accounts
• Not sharing account credentials with unauthorized individuals
• Promptly reporting to NexusRise if you suspect your connection is being used for unauthorized or abusive purposes
• Securing any IoT or smart home devices connected to your NexusRise network

NexusRise is not liable for damages resulting from a subscriber's failure to maintain reasonable security practices on their devices or local network.

7DMCA & Copyright Compliance

NexusRise complies with the Digital Millennium Copyright Act (DMCA). If you believe content accessible through our network infringes your copyright, please send a written notice to our designated agent at admin@allexapiegroup.com with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on our network
• Your contact information (name, address, phone, email)
• A statement of good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in the notice is accurate
• Your physical or electronic signature

Repeat infringers may have their service terminated in accordance with our repeat infringer policy.

8Consequences of Violation

NexusRise reserves the right to take any of the following actions in response to AUP violations:

NexusRise will determine, in its sole reasonable discretion, whether a violation of this AUP has occurred. We are not obligated to provide advance notice before taking action in cases involving illegal activity or immediate network harm.

9Reporting Violations

If you observe or suspect a violation of this AUP — including abuse, illegal activity, or network interference — please report it promptly to us at admin@allexapiegroup.com. All reports are taken seriously and will be investigated.

Reports can be made anonymously. However, providing your contact information allows us to follow up with you regarding the resolution.

10Changes to This Policy

NexusRise may update this AUP from time to time to reflect changes in our services, technology, or applicable law. We will notify subscribers of material changes via email or account notification at least 14 days before the changes take effect. Continued use of NexusRise services after the effective date constitutes acceptance of the updated AUP.

11Governing Law

This AUP is governed by the laws of the State of South Carolina, consistent with our Terms of Service. Any disputes arising under this policy are subject to the dispute resolution provisions outlined in our Terms of Service.
